EDITOR’S NOTE: This is the first of a two-part series concerning the issue of eminent domain utilization and controversial Carbon Capture and Sequestration projects. A recent ruling has sided with property owners on their constitutional rights to private property with exceptions only pertaining to strictly public use projects.
